General purpose of data collection, processing and use

The App is an art work containing an artistic experience by Studio Tomás Saraceno related to Spider/Webs (hereinafter: the App). On the basis of oracle questions submitted by you to the App and photographs of spiders or spider webs which you upload to the App, playful oracle sayings are randomly determined for you. The App also contains a Spider/Web map which can be accessed by every user of the App.

The purpose of the collection of data is to run the App.

The Spider/Web images as well as the GPS data related to it are used to generate a Spider/Web map which can be accessed by every user of the App by pushing the Spiderweb Button.

In addition to the use of the images in the App, Studio Tomás Saraceno GmbH will with you consent use the images and GPS data in order to generate a collaborative artwork with the images collected.

Data collected upon registration/login and use of such data

In order to use the App, it is necessary to register via a login mask.

When logging in, we ask you for a user name and an e-mail address.

With your consent (Art. 6 Abs. 1 lit. a GDPR) and only upon request, we use the e-mail address to send you a certificate which grants recognition of your contribution (uploaded Spider/Web image) to the collective artwork generated by the App. When logging in, you get the opportunity to choose the option “Receive Artwork Certificate”. If you chose this option, we may send you a certificate by e-mail certifying that you are the accredited owner of an art work, courtesy of Tomás Saraceno with Arachnophilia.

In order to enable other users to share their oracles with you, it is in our legitimate interest (Art. 6 Abs. 1 lit. f GDPR) that your e-mail address can be found by searching for it and there is a match. If you do not want your e-mail address to be found, you can provide for this in the settings.

When activating the App, you the App will ask you for your consent to access your location data when using the app (Art. 6 I lit. a GDPR). One of the features of this App is a “map against extinction”. Allowing the App the access to your location data will allow you to locate yourself with your current location shown by a red circle on the Spider/Web Map. Also, the App will locate the Spider/Web image uploaded by you on the Spider/Web map.

Data that is collected when you use the App and use of such data

In order to proceed with the artistic experience, you submit a question to the oracle.

You will then be asked to submit a photograph of a spider or spider web. The App will ask you for your consent to access to your camera (Art. 6 I lit. a GDPR). By allowing the App to access to your camera, you consent to the use of the image you chose to upload within the App.

When you upload a spider-related photograph, we also collect GPS data. The App asks you to allow access to your location data. By allowing the App to access to your location data, you consent (Art. 6 Abs. 1 lit. a GDPR) to the use of the GPS data in relation to the image.

With your consent (Art. 6 Abs. 1 lit. a GDPR), the App uses the GPS data in order to create a map containing Spider/Web images, which will also made visible to other users via the App and on a separate Website outside the App.

Other data collected

In addition, we collect data regarding your operating system as well as at what time and for how long you use the App. However, this data is not connected to your user profile. We do this in our own legitimate interest (Art. 6 Abs. lit. f GDPR) in order to assess whether the App is an interesting offer.

Tacking, Analyzing

We do not use Cookies or Analyzing tools.

Disclosure of data to third parties

Personal data will only be transferred to third parties if this is necessary for the use of the App so with the purpose of the performance of the contract between you and us (Art. 6 I lit. b GDPR), e.g. to our hosting provider who provides the storing capacity on a server in Germany.

Your rights

You can assert your following rights against Studio Tomás Saraceno GmbH at any time and free of charge:

Right to information: You have the right to receive information from us about the processing of your personal data.

Right of rectification: You have the right to ask us to rectify any incorrect or incomplete personal data concerning you.

Right to deletion: You have the right to demand the deletion of your data if the conditions specified in Art. 17 GDPR are met. You may, for example, request the deletion of your data which is no longer necessary for the purposes for which it was collected. You can also request deletion if we process your data on the basis of your consent and you revoke this consent.

Right to limitation of processing: You have the right to demand limitation of the processing of your data if the requirements of Art. 18 GDPR are met. This is the case, for example, if you dispute the accuracy of your data. For the duration of checking the correctness of the data, you can then demand that the processing be restricted.

Right to object: You may object to the data processing for reasons arising from your particular situation even if the data processing was carried out on the basis of our legitimate interests.

Right to data portability: You have the right to receive your data in a structured, common and machine-readable format and to transfer it to another data processor.

Right of revocation: If data processing is based on consent, you have the right to revoke your consent with effect for the future at any time free of charge at info@t-saraceno.org or via the contact details given in the imprint.

Right of complaint: You also have the right to complain to a supervisory authority (e.g. the State Data Protection Commissioner for Berlin (Landesdatenschutzbeauftragter Berlin) about our processing of your data.

Push messages

We send you push messages to inform you about projects, events and exhibitions by and with Studio Tomás Saraceno GmbH. Push messages are messages that are displayed on your device even when you are not using the app. We will only send you push messages if you have consented to receive them by activating the push messages (Art. 6 para. 1 sentence 1 lit. a GDPR). Upon activation, the device ID of your mobile device is communicated to the service that provides the push functionality at your operating system provider. You can deactivate the sending of push messages at any time and thus withdraw your consent by changing the settings of your device (iOS: Settings > App Name > Notifications; Android: Settings > Apps or Application Manager > App Name > Notifications). Please note that the revocation only takes effect for the future. Processing that took place before the revocation is not affected.



Material

Any material, data, imagery and sound collected may be used by Aerocene Foundation for any artistic, scientific, educational or other purposes without restriction to any specific media, including, without limitation, press use, books, publications, films, video materials or exhibitions dealing with Aerocene, world-wide and unlimited in time. All images created and shared by Aerocene Foundation under the use of the Float Predictor are licensed under CC Creative Commons Share-A-Like Attribution which means users are free to share and adapt the material as long as they distribute their contributions under the same license as the original. Any personal data relating to users gathered by Aerocene Foundation in the website user process or during your use of the service will be recorded and only be used in accordance with https://ec.europa.eu/info/law/law-topic/data-protection_en.
